This application is for grant of anticipatory bail in connection with Falka (Pothia) P.S.Case No.133 of 2016 dated 16.6.2016 for the offence under Sections 363 and 365 of the Indian Penal Code.

It is submitted on behalf of the petitioner that except that the victim girl was seen going along with the petitioner and one another accused person in a Tempo for College, there is nothing in the case diary against the petitioner and he is a student. The petitioner has clean antecedent.

Heard learned A.P.P. also.

Having heard both sides. From perusal of the case diary,

Patna High Court Cr.Misc. No.45143 of 2016 (3) dt.23-01-2017 2/3 it appears that no specific allegation has been attributed against the petitioner and only suspicion has been raised as he was also going with the victim girl in the Tempo for the College, let the petitioner, above named, in the event of arrest or surrender before the court below within a period of six weeks, be released on provisional bail on furnishing bail bond of Rs.25,000/- (twenty five thousand) with two sureties of the like amount each to the satisfaction of Sri Sunil Kumar-III, Judicial Magistrate Ist Class, Katihar in connection with Falka (Pothia) P.S.Case No.

133 of 2016, subject to conditions as laid down under Section 438 (2) of the Code of Criminal Procedure with a condition that he will cooperation in the investigation of the case and make available himself before the police as and when required and once the charge-sheet is submitted in this case against the petitioner, he will surrender before the court below and make prayer for regular bail before the learned court below, which will be decided on its merit without being prejudiced by the order of this Court. With the aforesaid observation, this application is disposed of.
