JUSTICE ASHWANI KUMAR SINGH ORAL ORDER 19-09-2017 Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner seeks pre-arrest bail in connection with Thakraha (Bhitahan) P.S. Case No. 27 of 2017 registered under Sections 379, 411 of the Indian Penal Code and Section 33 of the Indian Forest Act.

It is submitted by the learned counsel for the petitioner that in the given facts and circumstances of the case ingredients of the offence punishable under Sections 379 and 411 of the Indian Penal Code are not attracted. She has

No.41610 of 2017 (2) dt.19-09-2017 submitted that name of not a single person has been disclosed in the FIR who has seen the petitioner cutting the tree in question and the entire case is based on suspicion and due to village politics, the name of the petitioner has been roped in the instant case.

Having regard to the nature of allegation as also the fact that the petitioner has got no criminal antecedent and has got roots in the society, in the event of arrest or surrender in the court below within six weeks from today, the petitioner is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M.-1st, Bagaha, West Champaran in connection with Thakraha (Bhitahan) P.S. Case No. 27 of 2017 subject to the conditions as laid down under Section 438(2) Cr. P.C.
