JUSTICE VINOD KUMAR SINHA ORAL ORDER 22-05-2019 The petitioner seeks regular bail in connection with Mahua P.S. Case No. 11 of 2017, registered for offences punishable under Sections 307, 324, 302 and 34 of the Indian Penal Code.

Allegation as per F.I.R is that one Vinod Singh fired on the informant and Baidyanath Sing also made indiscriminate firing on the deceased causing his death and allegation against this petitioner is of assault to one Sanjay Singh by means of sword.

It has been submitted on behalf of the petitioner that there is no allegation against him of assaulting the deceased rather it is alleged that he assaulted one Sanjay Singh by means of sword and he has been in judicial custody since 08.01.2019

Patna High Court CR. MISC. No.25558 of 2019(3) dt.22-05-2019 2/2 having no criminal antecedent.

Heard learned A.P.P. also.

Having heard both sides, in view of the above facts, let the petitioner above named, be released on bail on furnishing bail bonds of Rs. 25,000 (Rs. Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Vaishali at Hajipur, in connection with Mahua P.S. Case No. 11 of 2017, subject to the condition that petitioner will cooperate in disposal of trial and make himself available as and when required by the court below, failing which, the prosecution shall move for cancellation of his bail bonds.
