JUSTICE DINESH KUMAR SINGH ORAL ORDER 14-01-2016 Heard learned counsels for the petitioners and the State. The petitioners being parents of the husband of the informant apprehending arrest in a case registered for the offences punishable under Sections 341, 323, 307 and 498A/34 of the Indian Penal Code.
The basic accusation is of torture. It is also alleged that the informant was confined in the room and also assaulted by the accused persons.
It is submitted by learned counsel for the petitioners that thrust of accusation is against the husband of the informant who has been granted bail by learned court below on the basis of compromise, statement to that effect has been made in para 7 of the petition which reads as follows:- "That the husband of the informant Ajay Bharti has been granted bail by the court below itself on the
Patna High Court Cr.Misc. No.2173 of 2016 (2) dt.14-01-2016 2/2 ground of compromise between the parties."
Considering the aforesaid facts, let the above named petitioners be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned SDJM, Raxaul at Motihari, East Champaran in connection with Darpa P.S. Case No. 61 of 2015, subject to the conditions as laid down under Section 438(2) Cr.P.C.
