2. Petitioner apprehends his arrest in connection with Bachhwara P.S. Case No. 230 of 2023 registered on 24.07.2023 under Sections 341, 323, 307, 379, 354, 504/34 of the Indian Penal Code.

3. As per prosecution case, the petitioner is alleged to have assaulted the informant on her head by means of spade.

4. Learned counsel for the petitioner submits that petitioner is innocent and has falsely been implicated in the present case due to some land dispute. It is further submitted that both the parties are agnates and there is case and counter case between them inasmuch as Bachhwara PS Case No. 234/2023 has been registered by the aunt of the petitioner

Patna High Court CR. MISC. No.32202 of 2024(2) dt.21-05-2024 2/2 against the informant and others. Petitioner has got no criminal antecedent.

5. Having considered the above facts and circumstances of the case, prayer for anticipatory bail of the petitioner is, hereby, allowed. In the event of arrest/surrender within six weeks from today, let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Begusarai, in connection with Bachhwara P.S. Case No. 230 of 2023, subject to the conditions as laid down under section 438(2) of the Code of Criminal Procedure.
