JUSTICE DINESH KUMAR SINGH ORAL ORDER 18-12-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 457 and 380 of the Indian Penal Code.
On theft being committed of CFL bulbs and fan from the godown of the informant FIR was lodged against unknown. During investigation, on confession of Ram Sakal Yadav, it transpired that the petitioner and co accused Vijay Mahto purchased the stolen articles kept in godown of the brick kiln. Subsequently, the part of stolen articles were recovered from the alleged godown.
It is submitted by the learned counsel for the petitioner that the recovered articles are not stolen one and they have not
Patna High Court Cr.Misc. No.57168 of 2015 (2) dt.18-12-2015 2/2 been put on Test Identification Parade. Statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent. More over, Ram Sakal Yadav has been granted bail. Let the learned court below consider the prayer for regular bail of the petitioner in case the petitioner surrenders within six weeks from today in connection with Jai Nagar P.S. Case No. 180 of 2015 pending in the court of learned S.D.J.M. Madhubani. This application is disposed of with the aforesaid observation/direction.
