JUSTICE VINOD KUMAR SINHA ORAL ORDER 28-02-2018 By way of the present application, the petitioner seeks for modification of the order dated 08.11.2017 passed in Cr. Appeal (SJ) No. 10 of 2017, by which the petitioner was directed to surrender before the court below within a period of six weeks and on his surrendering, the Special Judge was directed to release the petitioner on bail to his own satisfaction. Submission of learned counsel for the petitioner that petitioner met with an accident and due to which, he could not surrender within the time prescribed by this Court. In support of his contention, he has annexed his phtograph, which is annexure - 2 to this petitioner and, therefore, the petitioner may be allowed a further period of four weeks to surrender before the court below. Considering the facts and circumstances of the case, order dated 08.11.2017 is modified to the extent that a further

Patna High Court Cr.Misc. No.8379 of 2018 (2) dt.28-02-2018 2/2 period of four weeks is allowed to the petitioner to surrender in the court of Special Judge.

Accordingly, this modification application is allowed.
