1. Heard learned counsel for the petitioners and learned A.P.P. for the State.

2. The learned counsel for the petitioners, at the outset, seeks permission to withdraw the present quashing application with respect to petitioner no.1, namely, Babita Devi, who died during the pendency of the present quashing application.

3. Permission is accorded.

4. Accordingly, the present quashing application is dismissed as withdrawn as having become infructuous with respect to petitioner no.1, namely, Babita Devi.

5. The learned counsel for the rest petitioners seeks permission to withdraw the present quashing application with a liberty to the petitioners to raise all the issues at the time of framing of charge, if the charges, till date, have not been framed.
