JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 05-02-2021 Heard learned counsel for the petitioner and learned Additional Public Prosecutor appearing on behalf of the State. The petitioner is apprehending arrest in connection with Dariapur P.S. Case No. 462 of 2019 for offence under Section 392 of the Indian Penal Code.

Considering the materials available on record including the case diary, the Court is not inclined to grant the privilege of anticipatory bail to the petitioner. Prayer for anticipatory bail is rejected.

However, in the event the petitioner surrenders before the court below and seeks regular bail, the court below shall consider and dispose of the same on its own merits on the same
