JUSTICE NAVANITI PRASAD SINGH ORAL ORDER 22-12-2015 The petitioner being the husband apprehends his arrest in Simari P.S. Case No. 10 of 2015 instituted under Sections 498A / 323/379/504/506 of the Indian Penal Code and Section 3⁄4 of the Dowry Prohibition Act.
Learned counsel has drawn the attention of this Court to the order of learned Session Judge, Darbhanga by which the petitioner's anticipatory bail application was rejected. It is noticed in the order of Sessions Judge that the he tried for re-conciliation between the parties. It is recorded that the petitioner was ready and willing to keep the lady but she refused. Curiously that being the situation, he refused to grant anticipatory bail to the petitioner. He has also recorded that a compromise petition had also been filed between the parties. I beg to say that what the learned Judge achieved by dismissing the application for anticipatory bail.

Case No. 10 of 2015, subject to the conditions as laid down under Section 438(2) of Cr. P.C. (Navaniti Prasad Singh, J) Saif/- U T
