The petitioner is apprehending arrest in connection with Sonepur P.S. Case No. 911 of 2018 for offences under Sections 147, 149, 341, 353, 307, 504, 188, 379, 411 IPC, 3/8(a) BPIMTS Act 2003 & 3th of the prevention of damages to Public Property Act, 1984 and 15 of Environmental Protection Act, 1986.

It is alleged that the vehicle of the petitioner was used in illegal transportation of sand. The driver of the truck could not produce any document regarding the sand and he confessed illegal loading of sand.

Learned counsel for the petitioner would submit that the petitioner has no criminal antecedent. The petitioner is

Considering the fact that the petitioner has no criminal antecedent and he is not named in the FIR, the Court is inclined to grant anticipatory bail to the petitioner on deposit of cash of Rs. 25,000/-. Let the petitioner, above named, in the event of arrest or surrender within four weeks from the date of communication of the order, be released on bail on furnishing bail bond of Rs. 25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the ACJM, 1st Saran At Chapra in connection with Sonepur P.S. Case No. 911 of 2018, subject to deposit of cash of Rs. 25,000/- and further subject to the conditions as laid down under Section 438(2) Cr. P. C.

The deposit of cash of Rs. 25,000/- shall abide by the final outcome of the present pending criminal case. (Anil Kumar Upadhyay, J) spandey/- U T
