1. Heard learned counsel for the petitioner and learned A.P.P. for the State.
2. Learned counsel for the petitioner, after some arguments, seeks permission to withdraw this application.
3. Permission is accorded with liberty to raise all the issues at the time of framing of charge as it has been submitted by the learned counsel for the petitioner that petitioner has been falsely implicated in the present case and at the relevant point of time when the occurrence is alleged to have been taken he was posted as a Headmaster and he also got the award of the best Headmaster. It is further submitted that on the relevant date at the time of occurrence he was in school and he had documentary evidence to substantiate the same but inadvertently the same could not be brought on record in the present application.

4. Accordingly, this application is dismissed as withdrawn.
5. The Court expects that if the discharge application is filed as it has been submitted by the learned counsel for the petitioner that till date charges have not been framed, the learned trial court shall apply its independent mind and will also look into the documentary evidences if any brought on record to substantiate the plea as raised in the present application which stands recorded hereinabove.
