JUSTICE DINESH KUMAR SINGH ORAL ORDER 17-12-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Section 273 of the Indian Penal Code and Section 47(a) of the Excise Act.
Huge quantity of foreign liquor and beer was recovered from the house of the petitioner.
It is submitted by learned counsel for the petitioner that the recovery is made from the joint family house and the area from where the seizure was made was allotted to the share of Alok Kumar who is the signatory to the seizure list. Moreover, a statement has been made in para 3 of the petition that the petitioner has no criminal antecedent.
The aforesaid facts constitute good ground for
Patna High Court Cr.Misc. No.56935 of 2015 (2) dt.17-12-2015 2/2 consideration of prayer for regular bail.
Let the learned court below consider the prayer for regular bail of the petitioner if he surrenders within a period of six weeks in connection with Raj Nagar P.S. Case No. 167 of 2015 pending in the court of learned JM, 1st Class, Madhubani. Accordingly, the application is disposed of.
