Petitioner apprehends arrest in connection with Samastipur Mufassil P.S. Case No. 195 of 2018 registered for the offence punishable under sections 314, 323, 379, 406, 420, 504, 506/34 of the Indian Penal Code. Learned counsel appearing for the petitioner submits that petitioner has been falsely implicated in this case. Petitioner is only a Cashier whose duty is to issue receipts on deposit of collected amount by the agent and the entire administrative control vests with the Chairman of the PACCS. As a matter of fact, the informant had made quarrel with Manager also and filed this false case against this

Patna High Court CR. MISC. No.24608 of 2019(2) dt.17-04-2019 2/2 petitioner and the said Manager. Moreover, the the said Manager, Ravindra Kumar, having more or less similar allegations, has been allowed bail by this Court vide order dated 30.08.2018 passed in Cr. Misc. No. 49843 of 2018 as contained in Annexure-2. Petitioner is a man of clean antecedent.

Considering the facts and circumstances of the case and the submissions advanced on behalf of the parties, let the petitioner, above named, in the event of arrest or surrender within a period of four weeks from today, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate, 5th, Samastipur in connection with Samastipur Mufassil P.S. Case No. 195 of 2018 subject to the conditions laid down under section 438(2) Cr.P.C.
