In this case, the petitioner is seeking anticipatory bail in connection with Parbatta (Bharatkhand) P.S. case No.315 of 2017, registered for the offence punishable under Sections 147, 149, 341, 323, 188, 120(B), 504, 353, 109 and 151 of the Indian Penal Code.
Allegation has been made that in order to remove the encroachment the informant along with the associating party has gone to the place for removal of encroachment, but the villagers have assembled and blocked the route and did not allow to carry out the removal of encroachment. Many times money was given, but it did not affect any manner. In videography the petitioner has been identified, who was present at the place of
Patna High Court Cr.Misc. No.5944 of 2018(2) dt.02-02-2018 2/2 occurrence. There is no specific allegation against the petitioner, save and except he was present.
Looking to the aforesaid facts, let the petitioner, namely, Ravi Das @ Ravindra Kumar Das @ Ravindra Kumar, be released on anticipatory bail in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand only) with two sureties of the like amount each to the satisfaction of the Addl. Chief Judicial Magistrate-I, Khagaria in connection with Parbatta (Bharatkhand) P.S. case No.315 of 2017, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
It is made clear that the petitioner will co-operate in the investigation and whenever he was called by the police he will present himself. In failure to appear on two consecutive dates, the Investigating Officer will be at liberty to pray before the court below for cancellation of anticipatory bail. (Shivaji Pandey, J) Narendra/- U T
