Heard the learned counsel for the petitioner as well as the learned Additional Public Prosecutor for the State. The petitioner apprehends his arrest in connection with Athmalgola P.S. Case No. 185 of 2019 registered for offence punishable under sections 143, 341, 342, 323, 307, 302 of the Indian Penal Code.

The learned counsel for the petitioner has submitted that although the petitioner is named in the FIR, but there was no specific allegation of pressing throat of the deceased against the present petitioner and the co-accused Anukul Kumar @ Akul

Patna High Court CR. MISC. No.37022 of 2021(2) dt.07-04-2022 2/2 Kumar @ Ankul Kumar, against whom there is specific allegation of pressing throat, has been granted regular bail by the coordinate Bench in Cr. Misc. No. 28307 of 2020. As such, the petitioner is on better footing than co-accused Anukul Kumar @ Akul Kumar @ Ankul Kumar.

Considering the above-mentioned facts and circumstances, the petitioner, Ravi Kumar @ Ravi Ranjan Kumar, in the event of his arrest or surrender, within four weeks from today, is directed to be released on bail on furnishing bail bonds of Rs.10,000/- with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, Barh, Patna in connection with Athmalgola P.S. Case No. 185 of 2019, subject to condition as laid down under section 438(2) Cr. P.C.

Office shall ensure that all defects are removed by the petitioner within the stipulated time mentioned hereinabove, failing which, the matter shall be brought to the notice of this Court.
