The petitioner apprehends his arrest in connection with Haspura P.S. Case no. 203 of 2018, registered under Section 409 of the Indian Penal Code.

Petitioner who happens to be Panchayat Secretary is said to have not furnished the merit list of the selected teachers by 30.07.2016.

It is submitted by learned counsel for the petitioner that there is no allegation of any sort of misappropriation against the petitioner rather allegation is of non-compliance of the order as such no offence under Section 409 IPC is made out

Patna High Court CR. MISC. No.24745 of 2019(2) dt.18-04-2019 2/2 against the petitioner. Petitioner has no criminal antecedent. Similarly situated co-accused persons namely Md. Sahid Ali and Akshay Kumar have been enlarged on anticipatory bail by different co-ordinate benches of this Court.

Having regard to the facts and circumstances of the case, let the above named petitioner, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M., Aurangabad in connection with Haspura P.S. Case no. 203 of 2018, subject to the condition as laid down under Section 438

(2) of the Cr.P.C.
