Petitioner apprehends her arrest in a case registered for the offence punishable under Section 420, 379 and some other ancillary Sections of the Indian Penal Code. As per the prosecution case, the accused persons committed fraud with the informant by impersonating a lady and got a plot registered.

Learned counsel appearing for the petitioner submits that petitioner is innocent and has falsely been implicated in the case. Petitioner is daughter of the informant and she has executed the sale deed for the land of her share and being the daughter of informant she is legally entitled to sale her share. The informant has also filed a Title suit No. 108/2018 for

Patna High Court CR. MISC. No.27186 of 2022(2) dt.22-09-2022 2/2 declaring the sale deed illegal, unauthorized and without consideration. The dispute appears to be civil in nature. Petitioner has got clean antecedent.

Learned counsel appearing for the State opposes the prayer for anticipatory bail.

Considering the facts of the case, nature of accusation and clean antecedent of the petitioner, let the petitioner, above named, in the event of his arrest/ surrender within a period of six weeks from today shall be enlarged on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Judicial Magistrate, 1st class, Lakhisarai in connection with Halsi PS case No.202/ 2018, subject to conditions laid down u/s 438(2) of the Cr. P. C. (Prabhat Kumar Singh, J) BKS/- U T
