The petitioner apprehends his arrest in connection with Katihar Mufassil P. S. Case No. 88 of 2016 instituted under Sections 376 and 511 of the Indian Penal Code. The allegation, in brief, is that petitioner along with his associate made an attempt to rape informant. Submission is that petitioner has been falsely implicated in this case due to land dispute and complaint case was lodged belatedly after 05 days and this petitioner has got no criminal antecedent and the FIR has been lodged after three years of the complaint case.
Having considered the aforesaid facts and circumstances, let the petitioner, namely, Chhatthu Rishi, in the
Patna High Court Cr.Misc. No.39043 of 2017 (3) dt.17-10-2017 2/2 event of arrest or surrender before the court below within four weeks from today, be released on bail upon furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Katihar in connection with Katihar Mufasil P.S.Case No. 88 of 2016; subject to the conditions laid down under Section 438(2) of the Code of Criminal Procedure, 1973.
