JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 04-03-2016 Heard learned Counsel for the petitioner and learned Additional Public Prosecutor for the State. This application, for grant of anticipatory bail, arises out of Muzaffarpur Town Police Station Case No. 531 of 2011, disclosing offences under Sections 364 and 120B of the Indian Penal Code.

A complaint case filed by the informant is the basis for registration of Muzaffarpur Police Station Case No. 631 of 2011. Allegedly, son of one Garib Nath Rajak had taken the informant's son on the pretext of giving him books, whereafter the informant's son did not return. When the informant started searching for his son, the present petitioner is said to have told him that he had concealed his son and he would not be returning his son to him.

No.4552 of 2016 (3) dt.04-03-2016 2/2 Considering the fact that the First Information Report was instituted in the year 2011 and the petitioner, for the first time, approached the Court for grant of anticipatory bail in the year 2015, I am not inclined to grant him privilege of anticipatory bail, particularly, in view of the fact that till date, the child has not been recovered. This application is accordingly dismissed.
