JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 19-09-2017 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner apprehends his arrest in connection with Barun P.S. Case No. 23 of 2017, registered under Sections 304B and 201/34 of the Indian Penal Code.

The accusation is that complainant/informant, Chandeshwar Singh, performed the marriage of his daughter on 03.03.2015 with the petitioner. At the time of marriage, informant gifted Rs.10,00,000/- in cash and some articles to the petitioner and his family members, but in spite of that, petitioner demanded Maruti Car. Thereafter, daughter of the complainant went at her

Sasural, where she was being tortured due to non-fulfillment of demand of Maruti car. After 7-8 months, informant took his daughter in Bidai and Panchayati was arranged to pacify the matter. On 14.12.2016, when the witness Sudama Singh went at the Sasural of daughter of informant then he came to know that daughter of the informant had abode in haven and her dead body was disposed of.

Learned counsel for the petitioner submits that, in fact, petitioner is the husband of the deceased, daughter of the informant, and she was suffering serious ailments, in course of pregnancy, and was got treated at various places, but lastly she referred to the Avadh Hospital and Heard Centre at Lucknow, where she died in course of treatment and during that period informant was also present there, but later on with ulterior motive the present case has been lodged with false allegation. Having regard to the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Aurangabad, in connection with Barun P.S. Case No. 23 of 2017,

subject to the condition as laid down under Section 438(2) of the Cr.P.C.
