The petitioner who is in custody since 06.02.2019 in connection with Alauli P.S. Case No. 37 of 2019 registered for the offence under Sections 147, 148, 149 and 302 Indian Penal Code and Section 27 of the Arms Act has filed this application for bail.

The allegation against the petitioner and others is that all of them variously armed entered the house of the informant and thereafter, it is alleged that one Saheb Choudhary @ Baijnath Choudhary fired from his pistol on the son of the informant causing injury on his chest. He was taken for treatment but was declared dead on arrival at the hospital.

No.25522 of 2019(4) dt.31-07-2019 2/2 Having heard learned counsel for the parties and taking into consideration that co-accused Sanjay Poddar has been enlarged on bail vide order dated 22.05.2019 passed in Criminal Misc. No. 30052 of 2019, the main allegation as per the F.I.R. is on Saheb Choudhary and not the petitioner, the Court is inclined to enlarge the petitioner on bail. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- with two sureties of the like amount is to the satisfaction of learned Chief Judicial Magistrate, Khagaria, in Alauli P.S. Case No. 37 of 2019.
