Mr. Girijesh Kumar ====================================================== CORAM: HONOURABLE MR. JUSTICE MADHURESH PRASAD ORAL ORDER 27-08-2019 The writ petition has raised petitioner's claim for appointment as Block Resource Center Coordinator in Bagha Block No. 1, West Champaran.

Pursuant to advertisement in 2013 the petitioner had applied. The petitioner's claim is that the others have been appointed wheres petitioner has been made to run from pillar to post.

The State has filed a counter affidavit. The specific submission is that requisite qualification for selection in

Patna High Court CWJC No.14494 of 2014(2) dt.27-08-2019 2/2 question was master degree and B.Ed. Decree. The petitioner has submitted B.Ed. Degree from Navbharat Shiksha Parishad, Orissa, which is not a recognised institution. It is also stated in the counter affidavit that in the subsequent process initiated pursuant to advertisement in the yer 2014 the petitioner has applied without any objection.

The petitioner has not made any submission or assertion in support of validity of B.Ed. Degree issued by Navbharat Shiksha Parishad, Orissa.

Counsel for respondent No. 3 submits that even otherwise since now appointments to the post in question is being done under the new Rules of the year 2017 by the Bihar Education Project therefore the writ petition has also become infructuous.

From the records it is apparent that the stand of the State is as per the counter affidavit, copy of which has been served in May 2015 itself. No rejoinder or reply thereto has been filed disputing or denying the stand of the State authorities. The writ petitioner has not made out any legally enforceable right.

The writ petition is devoid of merit and the same is dismissed.
