The petitioners seek pre-arrest bail in connection with Fatehpur P.S. Case No.55 of 2017 registered under Section 366A/34 of the Indian Penal Code.
It is submitted by the learned counsel for the petitioners that the petitioners are mother and uncle (Phupha) of co-accused Pintu Kumar Ravidas with whom the daughter of the informant aged about sixteen years eloped. He has submitted that the petitioners had no role in the alleged occurrence. They have been implicated merely because they are relative of co-accused Pintu Kumar Ravidas. Patna High Court Cr.Misc. No.41467 of 2017 (2) dt.19-09-2017 2/2 cast against the petitioners in the first information report, which was instituted after nine days of the occurrence without assigning any reason for inordinate delay.
Learned counsel for the State has opposed the prayer for grant of pre-arrest bail to the petitioners.
Considering the facts and circumstances of the case, the petitioners, namely, Saro Devi and Ram Swarup Ravidas are directed to be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of A.C.J.M.-X, Gaya in connection with Fatehpur P.S. Case No.55 of 2017, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure, in the event of arrest or surrender before the court below within four weeks from today.
