2. The petitioner is apprehending his arrest in connection with Ramnagar P.S. Case No. 363 of 2022 lodged on 19.10.2022, for the offence punishable under Sections 406, 409, 420, 504, 506, 34 of the Indian Penal Code.
3. As per the prosecution, the petitioners along with other co-accused person being the Center Manager, Area Manager and Branch Manager of Micro Finance Company Ltd., Ramgarh have embezzled Rs. 5,68,764/- deposited y small time business man and workers and fled away leaving the company.
4. Learned Counsel for the petitioner submits that the
Patna High Court CR. MISC. No.27401 of 2025(2) dt.07-05-2025 2/3 petitioners is innocent and has committed no offence. Counsel submits that the petitioner is not at all involved in alleged wrong and he has unnecessarily been made accused in this case. He submits that from the allegation itself, it becomes clear that it is the Manager and local staffs of the person, who has committed the said wrong. Counsel further submits that the petitioner has no criminal antecedent.
5. Learned APP for the State opposes the prayer for bail of the petitioner and submits that petitioner is involved in this case as there is allegation in the FIR in which name of the petitioner is also there along with other accused persons.
6. As such, in the present facts and circumstances of this case, this Court is not inclined to grant bail to the petitioner. Accordingly, the prayer for anticipatory bail of the petitioner is hereby rejected.
7. It is hereby directed to the petitioner to surrender before the Trial Court within a period of 6 weeks from today. In case, the petitioner surrenders within six weeks, then the Trial Court is directed to pass order on his surrender-cum-bail application on the same day considering that whether petitioner is involved in said embezzlement of money or not, without being prejudice that the anticipatory bail of the petitioner has
