The petitioner's firearm licence has been suspended vide order dated 6.05.2013 passed by the District Magistrate, East Champaran, Motihari (Annexure-6) in view of his involvement in Pachchrukhi P.S. Case No.137/12 registered under Sections 341, 326, 379 of the Indian Penal Code and Section 27 of the Arms Act on the allegation that the petitioner has also fired from his gun due to which one Manita Devi has received injury.
It is contended on behalf of the petitioner that there is no material connecting the petitioner with the concerned occurrence as the victim Manita Devi has also stated on affidavit that she has not received injury from the firing by the petitioner.
Patna High Court CWJC No.14459 of 2014 dt.18-04-2016 2/2 Be that as it may, since the trial is going on, such contention of the petitioner cannot be accepted and such affidavit filed by the victim cannot be considered at this stage by this Court as every thing would be dependent upon final result of the trial. Accordingly, I do not find any reason for warranting any interference in the impugned order.
This writ application is dismissed.
However, it is made clear that in case the petitioner is acquitted of the charge finally then he would be at liberty to approach the licensing authority for revocation of suspension of his licence. (Dr. Ravi Ranjan, J) V.K. Pandey/- U
