JUSTICE DINESH KUMAR SINGH ORAL ORDER 10-12-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 341, 323, 324, 379 and 308/34 of the Indian Penal Code.

The accusation against the petitioner is of assaulting by the butt of the country made pistol causing injury on the head and right hand of the informant.

It is submitted by learned counsel for the petitioner that the injury of the informant has been found to be sharp cutting when one injury has been found to be grievous. It is submitted by learned counsel for the petitioner that the petitioner is the uncle of the informant and is 80 years old. The informatory petition was filed by the petitioner at earlier point of

Patna High Court Cr.Misc. No.56210 of 2015 (2) dt.10-12-2015 2/2 time.

Considering the nature of accusation, this Court is not inclined to grant anticipatory bail to the petitioner. Let the learned court below consider the prayer for regular bail of the petitioner if he surrenders within a period of six weeks in connection with Kamtaul P.S. Case No. 121 of 2015 pending in the court of learned Addl. Judicial Magistrate, Darbhanga.

Accordingly, the application is disposed of.
