2. The present criminal miscellaneous application has been filed under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (hereinafter referred to as 'the BNSS, 2023') for grant of anticipatory bail to the petitioner who apprehends arrest in connection with Rahui (Bhagan Bigha) P.S. Case No. 293/2025, lodged on 27.05.2025, under Sections 126(2), 115(2), 109(1), 74, 352, 351(3), 103(1) and 190 Bharatiya Nagarik Suraksha Sanhita, 2023, pending in the Court of learned Chief Judicial Magistrate, Biharsharif, Nalanda.
3. As per the prosecution, F.I.R has been lodged against five named accused persons including the petitioner.
Patna High Court CR. MISC. No.32663 of 2026(2) dt.13-05-2026 2/3 Specific allegation against the present petitioner that he has assaulted the mother of the informant due to which she fell down and received head injury due to which she died.
4. Learned Counsel for the petitioner submits that the the petitioner is innocent and has committed no offence. He submits that there is a dispute of transaction of money between the parties. He further submits that the informant side reached at the house of the petitioner and they have assaulted the petitioner due to which petitioner has filed a criminal case, which is annexed as Annexure P/2. He further submits that the antecedent of the petitioner is not clean. He is on bail in all cases. Counsel submits that the name of the petitioner has figured in this case due to earlier dispute exist between them and death has not been caused due to the action of the petitioner rather it is an accidental death in which allegation has been made against the petitioner. He submits that he is ready to fulfill all the conditions whatsoever shall be imposed upon him.
5. Learned Counsel for the informant vehemently opposes the prayer for bail and submits that there is direct allegation and due to the action of the petitioner the death of the mother of the informant caused. He submits that antecedent of the petitioner is not clean. There are three criminal cases
Patna High Court CR. MISC. No.32663 of 2026(2) dt.13-05-2026 3/3 pending against him. He further submits that anticipatory bail application of other co-accused have been rejected by a coordinate Bench of this Court vide order dated 27.04.2026 passed in Cr. Misc. No. 11539/2026.
6. Learned APP for the State opposes the prayer for bail of the petitioner and submits that there is specific allegation against the petitioner. He submits that material has also come against the petitioner in the case diary, which has been categorically acknowledged by the Additional Sessions Judge who had rejected the anticipatory bail application.
7. Considering the nature of allegation as well as criminal antecedent, this Court is not inclined to grant anticipatory bail to the petitioner. Hence, the prayer for anticipatory bail of petitioner is hereby refused. (Dr. Anshuman, J) Mkr./- U T
