Heard the parties.

The petitioner is apprehending his arrest in a case registered for the offence punishable under Sections 272/273 of the Indian Penal Code and Sections 30(a), 36 and 38 of the Bihar Prohibition and Excise Act.

From the house of the petitioner, liquor was recovered.

Considering the presumption of law under Section 32 and bar of prayer for anticipatory bail under Section 76 (2) of the Bihar Prohibition and Excise Act, I am not inclined to entertain the prayer of the petitioner for anticipatory bail, hence

Patna High Court CR. MISC. No.27741 of 2020(2) dt.25-11-2020 2/2 prayer is refused in connection with Ahiyapur P.S. Case No. 1451 of 2019.

The petitioner may surrender and pray for regular bail.
