JUSTICE ANJANI KUMAR SHARAN ORAL ORDER 28-04-2022 This is an appeal under Section 14(A)(2) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, 1989 (hereinafter referred to as 'the SC/ST Act') against the refusal of prayer of bail vide order dated 25.03.2021, passed by learned 6th Additional Sessions Judge-cum-Special Judge, POCSO Act, Nawada in connection with POCSO Case No.65 of 2018, arising out of Mahila Thana P.S. Case No.29 of 2018, registered under Section 376(AB) of the Indian Penal Code, Section 6 of POCSO Act as well as under Section 3(2)(V) of the SC/ST Act.

The appellant is said to have tried to outrage the modesty of the daughter of the informant.

By order dated 17.11.2021, report was called for regarding present stage of trial. Perused the report at Flag 'K'.

Patna High Court CR. APP (SJ) No.3224 of 2021(3) dt.28-04-2022 2/2 The Additional District & Sessions Judge-VI-cum-Special Judge, POCSO Act, Nawada reported that out of nine witnesses, eight witnesses have been examined.

Taking into consideration the fact aforesaid and the allegation levelled against the appellant, I am not inclined to enlarge the appellant on bail.

Accordingly, the prayer for bail of the appellant is rejected.
