2. The petitioner is apprehending his arrest in a case in connection with Maigra P.S. Case No. 50 of 2019 dated 30.12.2019 registered for the offence punishable u/s 392 of the Indian Penal Code.

3. As per the prosecution case, four unknown miscreants boarded on a Bolero are alleged to have snatched the key of the Haiwa truck from the informant and fled away with the vehicle.

4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. Nothing has been recovered from the conscious

The name of the petitioner has sprung up during the course of the investigation. Similarly situated co-accused has already been granted regular bail by this court vide order dated 11.07.2024 passed in Cr. Misc. No. 23081 of 2024. The petitioner has no criminal antecedent as stated in para 3 of the bail petition.

5. Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioner.

6. Considering the aforesaid facts and circumstances of the case, let the above named petitioner, in the event of his arrest/surrender within a period of six weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 20,000/- (Rupees twenty thousand) with two sureties of the like amount each to the satisfaction of the learned court concerned, Sherghati, Gaya in connection with Maigra P.S. Case No. 50 of 2019, subject to conditions as laid down under section 438(2) of the Code of Criminal Procedure.

7. The application stands allowed.
