The petitioner apprehends his arrest in connection with Karaiparsurai P.S. Case No.53 of 2016 registered under Sections 25(1-AA)B, 26 and 35 of the Arms Act.
On receiving the secret information about the preparation of illegal firearms in the orchard of co-accused Bhushan Paswan, the police reached there. On seeing the police, four persons started to flee away. While they were chased by the police but no one was apprehended. From the orchard of the co-accused Bhushan Paswan, several instruments for the preparation of illegal firearms and parts of firearm were recovered. The villagers, Dafadar and Chowkidars disclosed the name of four persons, who
Patna High Court Cr.Misc. No.43623 of 2016 (2) dt.19-10-2016 2/2 have fled away, as Bhushan Paswan, Pappu Paswan, Dhananjai Bind (petitioner) and Bidi Bind.
Learned counsel appearing on behalf of the petitioner submits that it would appear from the F.I.R. that the petitioner was not caught on the spot and due to dirty village politics, the villagers, Dafadar and Chowkidars, named the petitioner and others.
Having considered the facts and the circumstances of the case, let the petitioner, above named, in the event of his arrest or surrender by him within six weeks from today, be enlarged on bail on his furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate, Hilsa, Nalanda, in connection with Karaiparsurai P.S. Case No.53 of 2016, subject to the conditions laid down under Section 438(2) Cr.P.C. (Rajendra Kumar Mishra, J) P.S./- U T
