The petitioner is in custody in connection with Sessions Trial No. 169 of 2019 arising out of Raxaul Rail P.S. Case No. 91 of 2018 for the offence under Sections 328, 307, 379, of the Indian Penal Code.
Learned counsel for the petitioner submits that nothing incriminating was recovered from the possession of the petitioner. Petitioner is in custodysince 01.01.2019. Learned counsel for the petitioner submits that similarly circumstanced other co-accused namely Aashish Anand has been granted bail by the co-ordinate Bench of this Court in CR. Misc. No 19832 of 2019 vide order dated 02.04.2019.
Patna High Court CR. MISC. No.25638 of 2019(2) dt.22-04-2019 2/2 Considering the fact that the petitioner has no criminal antecedent and similarly circumstanced other co-accused has been granted bail by the co-ordinate Bench of this Court, the Court is inclined to grant bail to the petitioner. Let the petitioner named above, be released on bail on furnishing bail bonds of Rs. 10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned 6th Additional Sessions Judge, West Champaran, at Bettiah, in connection with Sessions Trial No. 169 of 2019, arising out of Raxaul Rail P.S. Case No. 91 of 2018.
