Petitioner seeks regular bail in a case registered for the offence punishable under Section 406, 420, 467, 468, 471 of the Indian Penal Code.

As per the prosecution case, this petitioner along with two other accused persons are alleged to have taken Rs. 28,50,000/- for sale of a land but they did not execute the sale deed and, thus, cheated the informant.

Learned counsel appearing for the petitioner submits that facts of the case indicates that it is civil dispute which is being converted into a criminal case. The petitioner has not taken any amount from the informant and he was only a witness

Patna High Court CR. MISC. No.36790 of 2021(2) dt.09-12-2021 2/2 of agreement dated 25.11.2016. Petitioner is in custody since 01.03.2021 and investigation in this case is complete. Learned counsel appearing for the State opposes the prayer for bail.

Considering the facts of the case and the period of custody of the petitioner, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Smt.
