The petitioner seeks bail in a case registered under Sections 328, 307, 379 of the Indian Penal Code. Allegation is that the accused persons forcibly pushed the informant down on Sitamarhi Railway Station, due to which he sustained injuries on his head and legs and they also took away Rs.31,000/- and mobiles.
It has been submitted on behalf of the petitioner that the petitioner is in custody since 31.12.2018. Charge sheet has been submitted in this case. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner has falsely been implicated in the present case. The identification of
Patna High Court CR. MISC. No.26234 of 2019(2) dt.23-04-2019 2/2 the petitioner has been made on the basis of photograph. No formal T.I.P. was conducted. Recovered mobile belongs to the petitioner. Except for this, there is no other substantive evidence to suggest the implication of the petitioner in the present case. On behalf of the State, it is submitted that the petitioner is named in the F.I.R.
Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned 6th Additional Sessions Judge, West Champaran at Bettiah in connection with Sessions Trial No.169 of 2019 arising out of Raxaul Rail P.S. case No.91 of 2018.
