2. The petitioner seeks regular bail in connection with Gardanibagh P.S. Case No. 418 of 2024 registered for the offence under Sections 64, 303(2), 351(3) and 3(5) of the Bharatiya Nyaya Sanhita, 2023.

3. The petitioner is the husband of the victim. It is alleged that he arranged for the victim, his own wife, to be raped by an unknown person who is also said to have snatched her mobile phone and cash amounting to Rs. 7,000/- before fleeing from the scene. The entire occurrence is stated to have been recorded by the petitioner himself. It is further alleged that the

Patna High Court CR. MISC. No.28571 of 2026(2) dt.11-05-2026 2/2 petitioner had been continuously harassing and torturing his wife for which she had earlier instituted a case against him. The informant has also alleged that the petitioner solemnized a second marriage without obtaining a divorce from the informant. The petitioner is in custody since 22.12.2025. The police has filed the charge-sheet against the petitioner.

4. Considering the aforesaid facts and circumstances and the nature and seriousness of the allegations levelled against the petitioner, this Court is not inclined to grant regular bail to the petitioner.

5. Accordingly, this application for regular bail stands rejected.

6. It is made clear that any observation made herein is prima facie in nature and limited solely for the purpose of adjudication of the present bail application. Such observations shall not be construed as an expression on the merits of the case and shall not influence the trial or any other proceedings in any manner.
