The petitioner is in custody in connection with Bettiah Town P.S. Case No. 1121 of 2018 for the offences under Sections 414, 399, 402 of the Indian Penal Code and Section 25(1-b)a, 26, 35 of Arms Act.

Learned counsel for the petitioner submits that the petitioner has no criminal antecedent and he is in custody since 31.12.2018. He further submits that arms was not seized from the conscious possession of the petitioner and allegation against this petitioner is that stolen motorcycle was seized from the possession of the petitioner.

Considering the fact that petitioner has no criminal

No.25218 of 2019(2) dt.22-04-2019 2/2 antecedent and he has remained in custody for more than four months, the Court is inclined to grant bail to the petitioner, let the petitioner, named above, be released on bail on furnishing bail bonds of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of Court of learned Chief Judicial Magistrate, Bettiah, District East Champaran in connection with Bettiah Town P.S. Case No. 1121 of 2018.
