Petitioners are in custody in connection with Sathi P.S. Case No. 34/2016 for the offence under sections 272, 273, 308, 34 of the Indian Penal Code and Section 47(A) of Excise Act.
Learned counsel for the petitioners would submit that petitioners have no criminal antecedent.
In the instant case total 105 of country made liquor was seized.
Learned counsel submits that nothing was recovered
Patna High Court CR. MISC. No.25324 of 2019(2) dt.22-04-2019 2/2 from the conscious possession of the petitioners. The petitioner no. is in custody since 22.1.2019, petitioner no.2 is in custody since 5.2.2019 and petitioner no. 3 is in custody since 8.1.2019.
Considering the fact that petitioners have no criminal antecedent, let the petitioners, named above, be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise, Bettiah, West Champaran, in connection with Sathi P.S.
