JUSTICE VINOD KUMAR SINHA ORAL ORDER 11-09-2019 This application, for grant of anticipatory bail, arises out of Majhaulia P.S. Case No. 377/2016, disclosing offences under Sections 498A/34 of the Indian Penal Code and Section 3/4 of the Dowry Prohibition Act.

Petitioner happens to be husband of the informant and allegation against the petitioner is of subjecting the informant to cruelty and torture with respect to non fulfilment of demand of dowry and also ousted from the house .

It appears that on appearance of opposite party no. 2, the matter was referred to Patna High Court Mediation and Conciliation Center, Patna and the report of learned Mediator is available on record, from which, it appears that the dispute between the parties have been resolved through the process of mediation and both the

No.25437 of 2019(4) dt.11-09-2019 2/2 parties are ready to reside together and opposite party no. 2 is residing with the petitioner and petitioner also undertook to give Rs. 1,000/- to opposite party no. 2 and they also agreed to get the case disposed of on the basis of compromise and both the parties have put their thumb impression on the memorandum of agreement. Both the parties have appeared and they have admitted the factum of compromise between the parties.

In such view of the matter, this application is disposed of with direction to the petitioner to surrender in the court below on 25.09.2019 along with opposite party no. 2 and the court below after verifying the compromise between the parties reached before the Mediator, shall release the petitioner on bail on furnishing bail bonds of Rs. 25,000/- (Rs. Twenty Five Thousand) with two sureties of like amount each to his own satisfaction in connection with Majhaulia P.S. Case No. 377/2016 subject to the condition as laid down under Section 438(2) Cr.P.C.
