Let the defect(s), if any, be removed within a period of four weeks from today.

The petitioner seeks bail in connection with Excise P.S. Case No. 47C2 of 2023 registered for the offence under Section 37(1) of Bihar Prohibition and Excise Act. Learned counsel for the petitioner submits that the petitioner is in custody since 16.01.2023 and no recovery was made from the possession of the petitioner and he was arrested only for drinking.

Learned A.P.P. has vehemently opposed the prayer for

Patna High Court CR. MISC. No.27713 of 2023(2) dt.15-05-2023 2/2 bail.

Considering the aforesaid submission of the learned counsel for the petitioner the period of custody, this application for regular bail is allowed.

Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge-V-cum-Exclusive Special Court-II, Excise Act, Lakhisarai in connection with Excise P.S. Case No. 47C2 of 2023.
