====================================================== CORAM: HONOURABLE MR. JUSTICE ALOK KUMAR SINHA ORAL ORDER 07-05-2025 Heard learned counsel for the petitioners and learned A.P.P. for the State .

2. Petitioners apprehend their arrest in a case registered for the offences punishable under Sections 126(2), 115(2), 303(2), 110, 74, 352, 351 and 3(5) of BNS, 2023.

3. The prosecution story in brief is that the informant namely Suraj Kumar stated in his written application that on 08.07.2024 at 09:30 AM, while he was taking meal then someone began to knock on the door when he opened the door and saw that FIR named accused persons were having armed

No.27802 of 2025(2) dt.07-05-2025 2/3 with rod, lathi and danda came and started abusing Ramand Paswan caught him and his son Chandan Kumar and began to assault with iron chain. In the meanwhile, when his mother came to rescue then Amarjeet Paswan assaulted his mother, Chitranjan Paswan snatched a gold chain of one bhar from his mother and in the meanwhile his cousin came who was assaulted by Mundirka Paswan and Manoranjan Paswan as he received injury and when they heard hulla his sister Puja Kumari and when maternal sister Priti Kumari came to rescue his mother who were assaulted by Niranjan Paswan by means of lahti and danda and a golden locket of Puja Kumari was snatched.

Learned counsel for the petitioners submits that petitioners are innocent and have been falsely implicated in the present case, it is next submitted that petitioners are persons with clean antecedent. Learned counsel for the petitioners further submits that petitioners were not arrested at the spot hence their presence at the place of occurrence is doubtful. It is also submitted that there is no independent witness to the occurrence in question. It is next submitted that allegations are general and omnibus in nature. 5. Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioner.

6. Considering the fact that petitioners are persons with clean antecedent and also the fact that injury caused to Suraj Kumar and Rakesh Paswan are simple in nature as per the Injury Report, this Court is inclined to grant the privilege of anticipatory bail to the petitioners.

7. Accordingly, the petitioners in the event of their arrest or surrender within four weeks from today, let the petitioners, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Court of learned J.M., 1st Class, Gaya in connection with Mahkar P.S. Case No. 136 of 2024, subject to the conditions laid down under section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023.
