The petitioner apprehends his arrest in connection with Triveniganj P. S. Case No. 209 of 2016 instituted under Sections 406 and 420of the Indian Penal Code. The allegation, in brief, is that Md. Rafique, one of the co-accused, promised to double the money of the informant and he had taken Rs. 1,10,000/- without any paper but the money was not returned as promised by him. When the informant demanded money then Md. Rafique and his son-in-law assured to return money and in lieu thereof, Md. Rafique agreed to give him Thresher and a motorcycle to the informant.

Learned counsel for the petitioner submits that allegation of taking money is not against this petitioner rather

Patna High Court Cr.Misc. No.37793 of 2017 (2) dt.11-08-2017 2/2 against one Md. Rafique and this petitioner is the son-in-law of him therefore, he has been falsely implicated in this case and he has got no criminal antecedent.

Having considered the aforesaid facts and circumstances, let the petitioner, namely, Md. Alam in the event of arrest or surrender before the court below within four weeks from today, be released on bail upon furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Supaul in connection with Triveniganj P. S. Case No. 209 of 2016; subject to the conditions laid down under Section 438(2) of the Code of Criminal Procedure, 1973.
