JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 23-04-2019 Heard learned counsel for the petitioner and the counsel appearing on behalf of the State as well as Informant. The petitioner is in custody in connection with Bagaha P.S. Case No. 116 of 2019 for the offences under Sections 324, 307, 34 of the Indian Penal Code read with Section 27/30 of the Arms Act.

Learned counsel for the petitioner submits that the petitioner has no criminal antecedent and he is in custody since 05.03.2019. He further submits that there is no allegation of any overt act against this petitioner. This fact is admitted by the counsel for the informant.

Considering the fact that petitioner has no criminal antecedent and there is no allegation of any overt act against this petitioner, the Court is inclined to grant bail to the petitioner, let
