The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 30(a) and 38(i) of the Bihar Prohibition and Excise Act, 2016 read with Sections 27(b)(2)/28 read with Section 36 of the Drugs and Cosmetics Act.

In the nature of allegation as alleged in the FIR and the fact that petitioner has antecedent under the NDPS Act also, the Court does not feel persuaded to extend the privilege of anticipatory bail to the petitioner. Accordingly, the prayer for anticipatory bail of the petitioner is rejected in connection with Jogbani P.S. Case No. 74 of 2019 pending in the Court of learned Special Judge, Excise-II, Araria/successor Court. (Satyavrat Verma, J) Kundan/- U T
