JUSTICE HARISH KUMAR ORAL JUDGMENT Date : 01-11-2022 Heard Mr. Kripa Nand Jha, learned counsel for the petitioner, Mr. Shashi Bhushan Singh, learned counsel for respondent no.3 and Mr. Narendra Kumar, learned AC to GP-20. No one appears on behalf of the Accountant General, Bihar.

2. A counter affidavit has been filed on behalf of respondent no.3 and the same is taken on record.

3. Learned counsel appearing on behalf of respondent no.3 contended that in compliance of order dated 22.09.2022, the answering respondent issued letter no. 76, dated 08.10.2022, with a request to Director (Higher Education), Education Department,

Patna High Court CWJC No.11699 of 2021 dt.01-11-2022 2/3 Bihar, Patna to issue sanction letter with respect to petitioner and in response to the aforesaid letter, sanction letter was issued vide letter no. 3127, dated 18.10.2022. He next contended that necessary documents have already been sent to the office of the Accountant General, Bihar, Patna through Special Messenger by 20.10.2022.

4. On the other hand, learned counsel for the petitioner submits that in spite of the sanction letter issued by the Director (Higher Education), Education Department, Bihar, Patna, till date no payment has been made to the petitioner.

5. In view of the facts and the submissions made on behalf of the parties, the present writ application is disposed of with a direction to the Accountant General, Bihar, Patna to ensure issuance of Pension Payment Order (PPO) and after issuance of the same necessary payment shall be made to the petitioner, as early as possible, preferably within a period of six weeks from the date of receipt/production of a copy of this order, failing which the petitioner would be entitled to statutory interest over the admissible sanctioned amount and the same shall be realized from the pocket of erring officer of the office of the Accountant General, Bihar, Patna or concerned Department.

6. With the aforesaid direction, the application stands disposed of.
