The petitioner apprehends his arrest in connection with Special Excise Case No.9442 of 2019, arising out of Mokama P.S. Case No.242 of 2019, registered under Section 30(a) of the Bihar Prohibition and Excise (Amendment) Act, 2018.

The accusation is that in course of patrolling duty, the informant along with other police personnel received secret information about selling the liquor by Govind Ram (petitioner) at his house in village-Mokama Ghat. Thereafter, the informant along with other police personnel reached there, then on seeing the police party, two persons started to flee away. On chase, one

No.27960 of 2020(4) dt.08-03-2021 2/3 person was apprehended but another person succeeded to flee away, The person, who was apprehended, disclosed his name as Vikas Kumar, son of Late Ram Lakhan, resident of villageSantar, Mohalla Ward No.14, P.S. and District-Lakhisarai, and also disclosed the name of the petitioner, who succeeded to flee away, saying that he is his brother-in-law in relation. On Search of the bag, which was in the hand of the apprehended person Vikas Kumar, 25 pouches, each containing 200 ml. Country Made Liquor, were recovered.

Learned counsel for the petitioner submits that it would appear from the F.I.R. that nothing was recovered from the house of the petitioner rather it is alleged that one Vikas Kumar was apprehended near the door of the house of the petitioner with bag, containing 25 pouches, each containing 200 ml. Country Made Liquor, and he also disclosed the name of the petitioner, who succeeded to flee away. The petitioner has no criminal antecedent.

Having considered the facts and the circumstances of the case, let the petitioner, above named, in the event of his arrest or surrender by him within six weeks from today, be enlarged on bail on his furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount
