JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER ----------- 28-07-2017 In compliance of the order dated 19.06.2017 passed by a Bench of this Court, Mr. Kishore Kunal Jha, the Investigating Officer of Arer P.S. Case No.100 of 2016, is personally present before this Court alongwith the learned A.P.P. for the State. Learned A.P.P. for the State submits that inadvertently, the injury report could not be annexed with the photocopy of the case diary of the aforesaid case for which an explanation was called for by the Investigating Officer of Arer P.S. Case No.100 of 2016 vide order dated 10.05.2017 passed by a Bench of this Court and the explanation on behalf of Mr. Kishore Kunal Jha, the Investigating Officer of Arer P.S. Case No.100 of 2016, is filed today before this Court.

Patna High Court Cr.Misc. No.12851 of 2017 (5) dt.28-07-2017 2/2 For the reasons assigned in the explanation filed by Mr. Kishore Kunal Jha, the Investigating Officer of Arer P.S. Case No.100 of 2016, his explanation is accepted and his personal appearance is dispensed with.

Learned counsel for the petitioner submits that since the petitioner has already been exonerated from the case, as detailed in paragraph-12 of the explanation filed by Mr. Kishore Kunal Jha, the Investigating Officer of Arer P.S. Case No.100 of 2016, he does not want to press this application and seeks permission to withdraw this application.

Permission is accorded.

Accordingly, this application, which has been filed on behalf of the petitioner to grant her anticipatory bail in connection with Arer P.S. Case No.100 of 2016, pending in the court of the Chief Judicial Magistrate, Madhubani, is dismissed as withdrawn. (Rajendra Kumar Mishra, J) P.S./- U T
