JUSTICE DINESH KUMAR SINGH ORAL ORDER 14-12-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Section 7 of the E.C. Act. The prosecution case is that as per the written report of Block Supply Officer, Mashrak, Sub Inspector of Mashrak Police Station seized 26 quintals 40 Kg. of rice from the house of Bhikhari Pandey. It is alleged that the rice was kept by the same petitioner in the house of Bhikhari Pandey for transferring into the general bags. Some empty bags had also been recovered from the house of Bhikhari Pandey. The petitioner however, is not a P.D.S dealer.

Considering that recovery has not been made from the petitioner, let the above named petitioner be released on anticipatory bail, in the event of arrest

Patna High Court Cr.Misc. No.56583 of 2015 (2) dt.14-12-2015 or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Saran at Chapra in connection with Mashrak P.S. Case No. 249 of 2015, subject to the conditions as laid down under Section 438(2) Cr.P.C.
