Petitioner apprehends his arrest in connection with Deep Nagar P.S. Case No.228 of 2015 for the offences registered under sections 304(B), 201/34 of the Indian Penal Code. Petitioner happens to be husband of the deceased and the marriage had taken place on 7.5.2014 but within three years of her marriage, she died due to burn injuries. There is allegation of illegal demand as well as torture.
Learned counsel for the petitioner seeks privilege of anticipatory bail on the ground that subsequently, the informant gave a petition before the court below that the present case was
Patna High Court Cr.Misc. No.37505 of 2016 (3) dt.18-11-2016 2/2 lodged under misconception and, as a matter of fact, the deceased was caught in fire accidentally.
Regard being had to the facts and circumstances of the case as well as submissions of the parties, I do not feel it proper to extend the privilege of anticipatory bail to the petitioner and, accordingly, his prayer for anticipatory bail in connection with Deep Nagar P.S. Case No.228 of 2015 pending in the court of Sri Rajeev Kumar Diwedi, Judicial Magistrate 1st Class, Bihar Sharif, District - Nalanda/concerned court stands rejected.
