====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 27-07-2023 Heard learned counsel for the petitioner and the State.
2. Petitioner apprehends arrest in a case registered for the offences punishable under Sections 419, 420, 471, 120(B) of the Indian Penal Code.
3. It is alleged that this petitioner along with other F.I.R. named accused persons has conspired and cheated the informant by withdrawing the amount from his account in the name of giving online tuition.
4. It is submitted that entire allegation levelled against the petitioner is false and concocted. As a matter of fact, petitioner is convenor of St. Xavier High School, Chakia where children of the informant were studying in different classes and petitioner has got no concern with the so called online tuition course provided by Bajaj Finance or any other institution.

Considering the facts and circumstances of the case, this anticipatory bail is allowed and it is ordered that let the above named petitioner in the event of his arrest/surrender before the court below within a period of six weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Judicial Magistrate, 1st Class, East Chmaparan, Motihari in connection with Chakia P. S. Case No. 323 of 2022, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
